KVKK General Clarification Text

In addition to our primary field of Islamic education activities, Kardeşim Association, which conducts humanitarian aid activities in countries and regions with poverty, ongoing warfare, and the aftermath of war, also demonstrates its sensitivity in the sector regarding the security of personal data. With this awareness, we attach great importance to the processing, storage, and deletion of special and general personal data of our visitors on all platforms in accordance with the Personal Data Protection Law numbered 6698, secondary regulations (regulations, communiqués, circulars) issued and to be issued within the scope of the Law, and decisions to be taken by the Personal Data Protection Board, binding in nature. We have prepared this information text to inform you about the personal data we process within the scope of our activities aimed at our purposes under the Law No. 6698 on the Protection of Personal Data (KVKK) and relevant legislation. As the "Data Controller" defined in the Law, we process your personal data within the framework explained below and within the limits prescribed by the legislation with the awareness of our responsibility.

1. DATA CONTROLLER

Kardeşim Association is the "Data Controller". "Ahmet Yesevi Neighborhood, Açıksu Street, 2260. Sk. No: 1/2, 63050 Haliliye/Şanlıurfa"

2. PURPOSES OF PROCESSING PERSONAL DATA

In addition to Islamic educational activities, the Kardeşim Association serves with humanitarian aid activities in disaster areas, regions affected by war and its effects, and in countries and regions with poverty. The Kardeşim Association needs to process personal data while directly fulfilling its legal obligations, as well as in situations indirectly required by these obligations and the services provided. In this sense, your personal data is processed by the Kardeşim Association;

To comply with the provisions and;

  • To fulfill our obligations set forth in the Labor Law No. 4857 and the secondary regulations issued under this Law,
  • To fulfill our obligations set forth in the Social Insurance and General Health Insurance Law No. 5510 and the secondary regulations issued under this Law,
  • To fulfill our obligations set forth in the Occupational Health and Safety Law No. 6331 and the secondary regulations issued under this Law,
  • To fulfill our obligations set forth in the Law on the Protection of Personal Data No. 6698 and the secondary regulations issued under this Law,
  • Regulation on Tenders for Foundation Cultural Assets dated 09.2008
  • To provide the information needed by the relevant public institutions and organizations, judicial or administrative authorities, and law enforcement agencies, if necessary,

your personal data is processed within the limits specified in the Law, in compliance with the law, the principle of good faith, and always in connection with these purposes, in a limited and proportionate manner.

3. TRANSFER OF PERSONAL DATA

Your personal data can be transferred to real and legal persons permitted by the legislation, relevant public institutions and organizations, judicial and administrative authorities, law enforcement agencies, institutions and organizations we have a business relationship with, authorities related to educational and humanitarian aid activities and relevant ministries, humanitarian aid associations with the same purpose that we collaborate with, and external consulting, technology and training companies that we receive services from, within the scope of the purposes listed above, in accordance with the conditions specified in Articles 8 and 9 of the Law.

4. METHODS OF COLLECTING PERSONAL DATA AND LEGAL GROUNDS

Your personal data is collected in oral, written or electronic environment through automatic or non-automatic methods using means such as e-mail, telephone, website, various contracts, forms and records kept on paper by real or legal persons authorized as data processors by the Kardeşim Association.

Visitor Name-Surname, Turkish ID number, phone number, e-mail, address information, entry-exit information, security records
Student Name-Surname, gender, nationality, parent's name, phone number, e-mail address, address information, signature, educational information, date of birth, place of birth, contact person information for emergencies, health information, educational information, passport information.

The special and general personal data specified in the table above are processed based on the legal grounds of the legitimate interests of the Kardeşim Association, in accordance with the provisions of Article 5/2/a-c-e-f and Article 6/3 of the Law, provided that they do not harm your fundamental rights and freedoms.

In addition to the data types listed above, your general and special personal data such as your association and foundation membership, civil society organization membership information and social media account information will be collected and processed within the scope of Article 5/1 and Article 6/2 of the Law with your explicit consent. In this sense, the explicit consent text signed by you will be an integral part of the disclosure text.

5. RIGHTS OF DATA OWNERS WITHIN THE SCOPE OF THE LAW

At any time, you can apply to the Kardeşim Association in the manner specified on our website and;

  • You can learn whether your personal data is processed or not, its purpose of processing and whether it is used in accordance with the purpose, and request information about this if it is processed,
  • You can learn the third parties with whom your information is shared domestically and abroad in accordance with the Law,
  • If you think your information is incomplete or incorrectly processed, you can request it to be corrected,
  • You can request the deletion or destruction of your information within the framework of the conditions set forth in Article 7 of the Law,
  • You can request your requests mentioned in (c) and (d) to be notified to the third parties to whom your information is transferred and to have the same procedures performed.

If your application made for these purposes requires additional cost, you will be required to pay the fee determined by the Communiqué on the Procedures and Principles Regarding the Application to the Data Controller issued by the Personal Data Protection Board. If a written response is given to your application, no fee will be charged for the first 10 (ten) pages, and 1 TL transaction fee will be charged for each page over 10 (ten) pages. If the response to your application is provided on a recording medium such as CD or flash drive, the cost of the recording medium will be reflected to you.

Your requests in your application will be finalised as soon as possible and within 30 (thirty) days at the latest, depending on the nature of the request.

You can submit your applications in writing to the Kardeşim Association, provided that they are in Turkish, and you can visit the website of the Personal Data Protection Authority to get detailed information.

Your applications;

Filling out the form on the website kardesim.org.tr and submitting a signed copy in person or via a notary to the address "Ahmet Yesevi Mahallesi, Açıksu Caddesi, 2260. Sk. No: 1/2, 63050 Haliliye/Şanlıurfa".

In your application, which includes your explanations regarding the rights you have as a personal data subject and the right you wish to exercise as mentioned above, the request must be clear and understandable, the subject of the request must be related to you, or if you are acting on behalf of someone else, you must submit a notarized power of attorney.

In your applications, the inclusion of elements such as name-surname, signature, Turkish ID number, residence or workplace address, e-mail address, telephone and fax number, and the subject of the request is mandatory in accordance with the "Communiqué on the Procedures and Principles Regarding the Application to the Data Controller". Applications that do not contain these elements will be rejected by the Kardeşim Association.

The Kardeşim Association reserves the right to make changes to this disclosure text at any time due to reasons arising from the Law, secondary regulations, and Board decisions.
